Commercial Truck Crashes in Tampa, FL
Commercial tractor-trailer, or truck, crashes are severe and cause immediate and devastating consequences. In 2009 in Florida alone, there were more than 3,200 reported crashes involving large trucks and buses. Trucks can weigh anywhere from 20 to 40 times the weight of the vehicles that they collide with on our roadways. These truck crashes can often be traced back to a failure on the part of the driver or the trucking company to follow laws that were specifically enacted to prevent the injuries that they have caused. Each and every driver and motor carrier operating a commercial motor vehicle, including straight trucks, tractors and semi-trailers (“semis” or “18-wheelers”) must follow specific laws, as set forth in the Federal Motor Carrier Safety Regulations, that are more strict than the laws that apply to regular automobiles and drivers. Our attorneys have experience investigating and litigating truck crashes throughout the State of Florida and the nation.
Why do you need an experienced trucking lawyer to handle your case? Because a trucking company will spare no expense in immediately investigating the crash and preparing its defense. They will hire attorneys, engineers, and trucking experts, oftentimes while our clients are still in the hospital trying to recover after the crash. You need attorneys with the resources and ability to meet and exceed the trucking company’s efforts. You need attorneys who will know which documents to request and which questions to ask. Our attorneys know the laws that trucking companies are required to follow and have taken truck crash cases to trial on behalf of both trucking companies and plaintiffs. Has your attorney litigated and taken to trial a truck crash case before? You should know, because the trucking company will.
Work Zone Crashes
Similar to commercial truck crashes, crashes in work zones are disastrous. Work zones have a significant amount of equipment, people and vehicles trying to share the same space, and often the same travel lanes. For these reasons, people and companies performing work in a work zone are required to follow very specific requirements to ensure the safety of the traveling public and the people working. When companies ignore or shortcut these requirements to save time or money, the results are catastrophic. According to the U.S. Department of Transportation, in 2010, there were 514 fatal crashes in work zone, resulting in 576 needless fatalities. While one a year is too many, that amounts to more than one death a day in a work zone. If you or a loved one has been involved in a work zone crash, we will go to work for you to find out what may have been done to prevent the very situation that you find yourself in now. And find out who was responsible.
Traumatic Brain Injury
Traumatic brain injuries lead to both immediate and long-lasting effects on our clients and our clients’ families. Today, we know more than ever about traumatic brain injuries. Still, brain injuries are one of the most difficult to diagnose and can sometimes be overlooked in the medical treatment provided shortly after a crash. Adding to this difficulty is the fact that every brain injury is different. Each area of the brain controls different function, so damage to different areas of the brain can cause different consequences. And while some brain injuries may present with a skull fracture or laceration, many brain injuries are not visible. Often, a person involved in a serious crash or impact will suffer from a diffuse axonal injury (or shearing), which is caused by rapid acceleration and deceleration of the brain, causing the nerve cells to stretch and compress. These types of injuries can have a significant impact on the cognitive function of the people who suffer from them. If you or a loved one has been involved in a serious crash or impact, traumatic brain injury should always be a consideration, as we have learned recently that a person can suffer a brain injury without even losing consciousness.
Our attorneys have litigated traumatic brain injury cases throughout the State of Florida and the nation. We have sat with the families of victims of traumatic brain injury at their kitchen tables and listened to the stories about how the event has changed the lives of everyone involved. We have helped guide our clients and their families through the medical treatment and legal battles that follow a crash and resulting traumatic brain injury. And we have taken traumatic brain injury cases to trial and verdict when absolutely necessary. Contact us to find out how we can help you and your family.
Spinal Cord Injury
Similar to traumatic brain injuries, spinal cord injuries can have severe and long lasting effects not only on our clients, but on our clients’ families. People suffering from a spinal cord injury should seek medical attention immediately, which can significantly affect the long-term outcome. Spinal cord or nerve root injuries can occur at many different levels of the spine. The symptoms and consequences differ significantly depending on the level of the injury and whether the injury is “incomplete” or “complete.” Symptoms can range from severe pain to loss of bowel and bladder function to complete paralysis.
In a case involving a spinal cord injury, we are prepared, along with our expert doctors, to work to prove the cause and severity of the injury. We have taken cases to trial involving spinal cord injuries, and we are prepared to do all we can for you.
Unfortunately, many catastrophic crashes cause the death of someone involved, leaving family and friends to try to make sense of the situation and pick up the pieces. Attorneys handling wrongful death cases should be particularly aware of the provisions in the Florida Wrongful Death Act, found at Sections 768.16 to 768.26, Florida Statutes, as well as the steps that need to be taken from filing the lawsuit through trial. There are very specific damages that can be recovered, and the lawsuit must “be brought by the decedent’s personal representative, who shall recover for the benefit of the decedent’s survivors and estate all damages … caused by the injury resulting in death,” as stated in Section 768.20, Florida Statutes.
We have taken wrongful death cases to jury verdict, and we are prepared to take on these tragic cases and fight for the survivors in seeking the justice they deserve.
Most people buy insurance hoping to never have to rely on it. But when an unexpected, catastrophic event occurs, those same people who have paid policy premiums for years without making a claim expect their insurance company to do the right thing. Unfortunately, insurance companies often fail to make payments or provide coverage when their policyholders need them the most. We are experienced in analyzing insurance policies and helping ensure that our clients receive the full amount of coverage that they are entitled to from their insurance companies.
We have litigated numerous types of business, commercial and real property disputes in federal and state courts throughout Florida. And we take the same approach in our commercial litigation cases as in any other case, aggressively fighting for our clients in litigation, negotiations, or at trial. Whether your personal or business interests have been interfered with by fraud, unfair and deceptive trade practices, or just corporate bullying, we are here to help. We are also willing to discuss alternative fee arrangements not found at larger commercial firms. Please call to discuss your case today, so that we can get your business interests back on track and moving forward.
We believe in fully representing our clients’ interests and staying actively involved throughout the entire litigation, trial, and appellate process. Our attorneys have prosecuted cases through appeal when necessary, and we are willing to continue to aggressively pursue justice for our clients even after the jury has rendered its verdict.
